Home » Ghiduri » Guide to classification as a professional client upon request Guide to classification as a professional client upon request Investimental grants the maximum level of protection provided by law to its individual and legal entity clients, except for institutional clients, and classifies them, as a standard rule, in the retail client category. In order to be classified as a professional client upon request, you must meet at least 2 of the following conditions at the time of submitting the request for classification, which must be supported by documentary evidence: a. Individuals: you have carried out on average 10 transactions of a significant size (over RON 3,500) per quarter over the last 4 quarters preceding the request for classification; the value of your portfolio of financial instruments, consisting of bank deposits and financial instruments, exceeds EUR 500,000 at the time of submitting the request for classification; you have worked for at least one year / have been working for at least one year in the financial sector in a professional position requiring knowledge of financial instruments / financial instrument transactions and financial investment services. b. Legal entities: the legal entity has carried out on average 10 transactions of a significant size (over RON 3,500) per quarter over the last 4 quarters preceding the request for classification; the value of the legal entity’s portfolio of financial instruments, consisting of bank deposits and financial instruments, exceeds EUR 500,000 at the time of submitting the request for classification; the individual authorized to carry out transactions on behalf of the legal entity has worked for at least one year / has been working for at least one year in the financial sector in a professional position requiring knowledge of financial instruments / financial instrument transactions and financial investment services. The supporting documents that may be submitted to demonstrate that you meet at least 2 of the criteria listed above are: bank account statement showing the value of bank deposits; portfolio statement showing the value of the financial instruments held; trading activity report for the last 12 months preceding the request, demonstrating compliance with the condition regarding the average number and value of transactions; a document evidencing compliance with the professional experience requirement (e.g. CV). You may request classification as a professional client by completing the relevant Application Form from the Investimental Portal / Documents section, which we kindly ask you to send back to us, together with the corresponding supporting documents, using the upload facilities available in the Investimental Portal / Client Documents / Upload a new document section. Investimental will assess your request, review the supporting documents submitted in support thereof, and communicate the outcome by means of a notification in the Notifications section of the Portal. Please note that classification as a professional client implicitly entails the loss of the rights granted by classification as a retail client and the waiver of the protection provided by the conduct of business rules applicable to retail clients, namely: professional clients fall into the category of investors whose investments are not compensated by the Investor Compensation Fund, in accordance with the law; you may receive less information regarding Investimental or the services provided by it (for example, regarding costs, commissions, fees, and charges); within the best execution framework, Investimental is not required to consider total transaction costs as the most important factor in achieving best execution; Investimental is not required to inform you of significant difficulties in the proper and timely execution of the order(s) placed; Investimental is not required to provide you with periodic statements with the same frequency as those provided to retail clients; Investimental may assume that, as a professional client, you possess sufficient knowledge and experience to understand the risks associated with investments in financial instruments and have the financial capacity to bear any associated risks in accordance with your investment objectives.
